1. Who we are

Capital Wealth Realty Inc. ("Capital Wealth Realty", "we", "us", "our") is a real estate brokerage serving Windsor-Essex and surrounding areas in Ontario, Canada. This policy explains what personal information we collect, how we use and protect it, and the choices you have. It applies to our website (capitalwealthrealty.ca), our online forms, our social media advertising and lead forms (including on Facebook and Instagram), and our communications with you by email, phone, text or messaging apps.

We handle personal information in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA), Canada's Anti-Spam Legislation (CASL), and the rules that apply to Ontario real estate brokerages.

2. Information we collect

We collect only what we need to respond to you and provide real estate services. Depending on how you deal with us, this may include:

• Contact details: your name, email address, phone number, and mailing address.
• Enquiry details: what you are looking for (for example buying, selling, leasing or investing), your preferred area, budget or timeline, and any message you send us.
• Information from lead forms: the details you enter when you submit a form on our website or on a Facebook or Instagram lead ad. Meta passes the answers you choose to submit to us.
• Messages: the content of emails, messages, or calls with us, and records of your appointments.
• Transaction information: if you become a client, details needed to complete your transaction, such as property details and closing dates, together with the documents the law requires us to collect.
• Occasion details: your birthday or the closing date of a home you bought through us, where you have given it to us, so we can send you greetings.
• Technical data: basic information such as your browser, device and pages visited, collected through cookies and similar tools on our website.

3. How we use your information

• To respond to your enquiry and contact you about properties, valuations and services you asked about.
• To schedule and manage appointments, showings and follow-ups.
• To provide real estate services and complete transactions, and to meet our legal and regulatory obligations.
• To send you marketing messages, such as market updates and newsletters, only where you have given consent (see section 5).
• To send occasional greetings (for example a birthday or home anniversary message) to contacts who have agreed to receive them.
• To measure and improve our website, advertising and service.
• To keep our systems secure and prevent fraud or misuse.

We do not sell your personal information.

4. Facebook and Instagram lead forms

When you complete a lead form on Facebook or Instagram, the information you submit is provided to us through Meta's lead ads service and is stored in our customer relationship management (CRM) system. We use it to contact you about your enquiry. Meta's handling of your information is governed by Meta's own policies: https://www.facebook.com/privacy/policy. You can withdraw from further contact at any time by telling us (see section 9).

5. Consent and email marketing

We ask for your consent before we collect, use or share your personal information, except where the law allows or requires otherwise. We send commercial emails and messages only with your express or implied consent as defined by CASL. Every marketing email includes our contact information and a way to unsubscribe, and we honour unsubscribe requests promptly. You can withdraw your consent at any time; this will not affect messages directly related to a transaction or appointment that you have already requested.

6. Who we share information with

We share personal information only when needed to provide our services, and only with:

• Our agents and staff who work on your enquiry or transaction.
• Service providers that help us operate, such as cloud hosting and database providers, email delivery services, and our CRM platform. They may only use the information to provide services to us.
• Parties to your transaction, such as lawyers, lenders, inspectors and other brokerages, where needed and with your knowledge.
• Regulators and authorities, where we are required by law (for example the Real Estate Council of Ontario).

Some of our service providers store data on servers outside Canada. Where this happens, your information may be subject to the laws of those places, and we require our providers to protect it appropriately.

7. How long we keep information and how we protect it

We keep personal information only as long as needed for the purposes above, and for the periods the law requires us to keep real estate records. When it is no longer needed, we delete or anonymize it. We protect information with technical and organizational safeguards, including access controls limited to authorized staff, encrypted connections, and secured cloud systems. No method of transmission or storage is completely secure, but we work to protect your information and will notify you and the authorities of any breach where the law requires.

8. Cookies and website analytics

Our website may use cookies and similar technologies to make the site work, understand how it is used, and measure our advertising. You can control cookies through your browser settings. Blocking some cookies may affect how the site works.

9. Your rights and how to contact us

10. Children

Our services are not directed to children, and we do not knowingly collect personal information from anyone under the age of majority without a parent or guardian's consent.

We may update this policy from time to time. The latest version will always be available on this page with the date it was last updated.
